MEMBERSHIP TERMS AND CONDITIONS
The ERBORIAN SEOULMATE Loyalty Program is a loyalty program (the "Program") operated by or on behalf of ERBORIAN, which is part of the L'Occitane Group.
Membership in the Program is open to any interested individual residing in the United States and who has reached the legal age of adulthood in their state of residence. The Program is strictly for your personal use, and only one account per person is allowed. Companies and associations may not participate in the Program. ERBORIAN reserves the right to exclude people who do not comply with these Terms and Conditions.
By becoming a Member of the Program, you agree that you have read and fully accept these terms and conditions applicable to the Program (the "Terms and Conditions") and any amendments that may be made to them. We invite you to regularly consult these Terms and Conditions and all related rules to which they refer, as well as the Frequently Asked Questions (FAQs) available to understand the membership and operating conditions of the Program. By registering for the Program, you also agree to be bound by our Privacy Policy and by the general Terms and Conditions relating to the use of the Erborian website, usa.erborian.com ("Website"), product purchases or other existing programs and/or agreements. If you do not expressly accept these Terms and Conditions, our Privacy Policy, and the general terms and conditions for use of the Website, you will not be able to participate in or benefit from the Program's advantages.
Membership in the Program and its benefits are entirely at ERBORIAN's discretion, which may terminate the Program at any time or modify the registration conditions, operating rules, benefits or other Program features by posting any modified elements on the Website. Your continued participation in the Program after these changes are posted confirms your acceptance and approval of the updates.
PROGRAM MEMBERSHIP
To join the Program and benefit from its advantages, you must have an ERBORIAN customer account (the "Account") and become a Member ("Member" or "you").
If you do not have an Account, you can create one by going to the Website at usa.erborian.com, clicking on "My account" and following the registration procedure in the "I want to create a new account" section. You will then automatically become part of the Erborian Loyalty Program.
Registration is free and with no purchase obligation.
No purchase is necessary to participate in the Program. Only one Account can be associated with an email address.
You agree to provide accurate, current, and complete information necessary to register for the Program and to promptly update this data so that it remains accurate, current, and complete. If you provide false, inaccurate, outdated, or incomplete information, or if ERBORIAN has reason to suspect that your registration information is false, inaccurate, outdated, or incomplete, or that you are abusing your Program membership in any way, ERBORIAN has the right in its sole discretion to suspend, terminate, or refuse your current or future participation in the Program. Each Member is solely responsible for maintaining the accuracy and updating of the personal information necessary to access their Account, and for correcting it directly on the Website.
PROGRAM PURPOSE AND OPERATION
The ERBORIAN SEOULMATE Loyalty Program is a way to reward and thank customers for their loyalty in purchasing our products and treatments, as well as their participation in certain online actions. You can earn points and reach different Program levels by making eligible purchases or performing different actions, thus beginning your journey. As you accumulate points and reach levels, you begin your journey and become eligible to receive benefits applicable to the level reached. Such benefits may change or be available for a limited time. Eligible purchases and other ways to earn points and reach different Program thresholds are published on the Website at https://usa.erborian.com/erborian-seoulmate-loyalty-program/.

The Member will accumulate points when the Member purchases goods or services from the Website (1 point per dollar spent) and through other eligible activities, excluding returns (as set forth below). The Program is tiered, based on the number of points accumulated in the Member's Account over a twelve-month period.
Members will attain various status levels. On the day you join the Program, you acquire the qualified status of Friend ("Friend") and are entitled to the corresponding benefits. You do not need to accumulate points to maintain the Friend level. On the day you start collecting points (the "Start Date"), a 12-month period begins ("Account Term"). You may attain a different status level based on the amount you spend with ERBORIAN during your Account Term. Your status level in the Program is determined by the total amount of your purchases during the Account Term:

Annual Recalculation of Status: At the end of each 12-month period that comprises your Account Term, your spending during the Account Term that just ended will be reviewed, and your Program status will be calculated according to the then-current status thresholds and, if different than your current status, it will be revised upward or downward accordingly.
Example: If you spend $180 during Account Term 1, you will attain LOVER level for Account Term 2. If by the end of Account Term 2 you spent only $60, then you will move to BESTIE level for Account Term 3. But if you spent $300 during Account Term 2, you will move to SOULMATE level for the following Account Term.
POINTS
To earn points, please ensure that (1) you are a Program Member, and (2) you are logged into your Account before placing any orders. The number of points potentially awarded for each action is determined by ERBORIAN at its sole and reasonable discretion. Only purchases made through your Account, online at usa.erborian.com, are eligible to earn points under the Program.
When your status level changes, you immediately benefit from all advantages associated with the new level. A new 12-month period starts for calculating the next renewal. Regardless of the status change, your points balance remains unchanged: your points are not reset when you reach a new level.
Points are credited to your Account the day after your order is shipped from the warehouse.
Points earned are valid for 12 months from their credit date on your Account. After this period, unused points expire automatically and are permanently lost. You will receive a reminder email 30 days before your points expire (subject to having agreed to receive Program communications).
Example: Points credited on January 15, 2025, will expire on January 15, 2026.
Points are deducted from your Account for the following reasons:
- If they were credited due to a technical error made by ERBORIAN;
- If they were obtained through fraudulent means or other activities that violate these Terms and Conditions or misuse of Program membership;
- In case of return or cancellation of the entire purchase, or in case of partial return or cancellation, the points corresponding to the non-retained part of the purchase will be deducted;
- If they have been redeemed for products or discount coupons attached to the Program, such deduction is permanent and cannot be reversed for any reason;
- In case of termination of your Program membership for any reason.
You can check your points balance:
- Directly on your account at usa.erborian.com. Your points balance is displayed in the loyalty section of your account dashboard when you are logged in;
- On the Loyalty Program page at usa.erborian.com/erborian-seoulmate-loyalty-program.
PROGRAM BENEFITS AND REWARDS
As a Program Member, you earn points based on your interactions with the Brand when logged into your Erborian Account, such as by:
- Purchasing products on www.usa.erborian.com;
- Creating your Account to register for the Program;
- Participating in specific actions offered on the Website (e.g., leave a review, subscribe to the newsletter) when offered and available.
As you accumulate points, you may redeem them for Rewards. Only interactions expressly indicated as eligible allow you to earn points. Actions and point allocation methods may change and are subject to modification.
To take advantage of offers and rewards, you must have accumulated the minimum number of points determined by ERBORIAN for each status level. Points can never be exchanged for money and have no cash value. Eligible Program participants may receive invitations by email when rewards are available if they have not opted out of receiving Program emails.
BENEFITS BY STATUS LEVEL
In addition to points and rewards, each status level affords Members benefits from exclusive advantages.
Benefits for All Status Levels
All Members, regardless of their status level, receive the following Benefits:
- 1 point per dollar spent on the Website.
- Promotional email offers (subject to Member's acceptance to receive marketing emails).
- Early access to promotional events, such as sales or Black Friday promotions (subject to Member's acceptance to receive emails).
- Birthday gift (subject to entry of the Member's date of birth in the Member profile and Member's acceptance to receive Program communications by email). The birthday gift is sent by email in the form of a promotional code. If you did not receive the email, the code is also accessible on the Program page under 'My rewards history'. The birthday gift is not cumulative with other offers. It is personal and non-transferable, and it can only be used once per year by the Member. It is valid only for 30 days after the birthday date associated with your Account.

REWARDS CATALOG
When you reach the first threshold for using rewards, you will be notified by email, provided that you have agreed to receive ERBORIAN marketing communications by email. Rewards can only be used with your next purchase on the Website. Rewards do not have an expiration date, unless otherwise specified at the time of issuance.
The Program offers two types of Rewards: free products and discount vouchers.
A. Free Products
You can exchange your points for ERBORIAN product rewards ("Rewards") according to the following thresholds (provided as examples):

Important:
- The Rewards catalog is subject to change at any time in ERBORIAN's sole discretion.
- Rewards are available while supplies last.
- ERBORIAN reserves the right to replace a Rewards product with another of comparable value.
- Rewards can only be used when ordering on the Website.
- Return of merchandise purchased with a discount voucher will be for the price actually paid after applying the discount.
- One of each Reward per transaction.
- Discount vouchers are not cash and have no independent value unless used as part of a Website purchase.
- Discount vouchers may not be transferred or sold.
CONDITIONS FOR USING BENEFITS
Rewards, Benefits, and Program offers are available while supplies last and/or until their expiration date if they are time-limited. If your online order is not completed for any reason, any free product rewards will be removed from the cart and the corresponding points will be automatically returned to your balance. Discount vouchers, once issued, are non-refundable and the redeemed points cannot be reinstated regardless of whether the order is completed. In case you receive an offer or reward that is damaged, incorrect or incomplete, contact ERBORIAN customer service. Free product rewards can only be redeemed in conjunction with the purchase of at least one full-priced item.
REFERRAL PROGRAM
The Program includes a referral system allowing you to offer your friends and family a welcome offer. The referral program is open to all Members regardless of their status level.
For the referee (the referred person)
Your referral code is accessible directly in the pop-in displayed after clicking on the referral email link. This code gives you $10 off on a minimum purchase of $40 on your first order on www.usa.erborian.com. This offer is valid once only, reserved for new customers with no existing account. It cannot be combined with other current offers or promotions, is non-refundable, non-exchangeable and has no monetary value. Not valid with our partner retailers.
For the referrer
You will receive your reward by email the day after your referee's order is dispatched. Your reward consists of a $10 discount voucher valid on a minimum purchase of $40 on www.usa.erborian.com. If your referee does not use their referral code, no reward will be sent to you. This offer cannot be combined with other current offers or promotions, is non-refundable, non-exchangeable and has no monetary value. Not valid with our partner retailers.
ERBORIAN reserves the right to modify or withdraw the referral program at any time.
GENERAL PROVISIONS
Program Accounts, Rewards, Benefits, and/or points cannot be transferred, shared, or combined with anyone else. Only the Account associated with a Website purchase can accumulate Benefits and/or points.
Benefits and points earned under the Program have no monetary value and are not transferable. You also have no ownership rights to Program benefits. The balance and/or points credited to your Account will be reduced or canceled, as applicable, if all or part of a purchase is returned or canceled or if the credit is obtained as a result of fraudulent or other activity. The balance and/or points credited to your Account will be reduced or canceled in case of a technical error by ERBORIAN. The sale, exchange, assignment, or transfer of any prize or Benefit offered by the Program, other than by us, is expressly prohibited.
Benefits cannot be exchanged or returned for points, for another product or service, or for a cash refund.
Products and services available under the Program and all samples we may provide you are for your personal use only. You may not sell or resell products, services, or samples purchased or otherwise received from us. We reserve the right to cancel or reduce the quantity of any order to be fulfilled and/or any product or service to be provided to you that, in our opinion and at our sole discretion, could result in a violation of our Website Terms and Conditions.
We are not responsible for Benefits and/or points lost or exchanged due to fraudulent activity or other violations of these Terms and Conditions on your part or that of a third party. If your membership is terminated for any reason, all your points and unredeemed Rewards will be lost.
We reserve the right to modify:
- Program Benefits;
- How points are accumulated;
- Program thresholds and levels;
- How we evaluate and reward your eligible purchases and/or any other Program activity.
We reserve the right to limit the number of purchases or activities eligible for the Program and/or for a certain threshold, the number or type of rewards or benefits you could receive or earn at a certain level, in a certain period, or for the duration of the Program and/or any combination of both options.
If you believe that a purchase or other activities have not been properly reflected on your account, please contact ERBORIAN customer service by email at USCustomerService@erborian.com. In the email, you must include your first name, last name, and email address associated with your Account for the Program, the date of the Program activity, and the problems you encountered. To request credit for the missing purchase or Account activity, you must contact us in this manner within fifteen (15) days from the date of purchase or relevant activity under the Program.
PROGRAM COMMUNICATIONS
To receive Program-related communications, log into your Account, select the option for "Your personalized offers and communications" after logging into "My Account" > "Newsletter" > "Manage your subscriptions." Examples of these communications are: welcome emails or other communications that help us ensure your account activity is monitored. If you unsubscribe from Program-related communications, you will no longer receive emails regarding Program status or Program Benefits.
By registering for the Program, you will not automatically be registered to receive marketing communications. If you agree to receive marketing communications, you can opt in during registration or at any time by visiting 'My Account' > 'Newsletter' > 'Manage your subscriptions' on usa.erborian.com.
You can stop receiving communications related to the ERBORIAN SEOULMATE Loyalty Program by accessing your account, then accessing "My notifications," "Newsletter â Manage your subscriptions" tab, and expressly choosing not to receive Program communications by checking the box that offers you the corresponding option.
TERMINATION AND MODIFICATION
The Program and its Benefits are offered at our sole discretion. At our discretion, we may cancel, modify, limit, or terminate these Terms and Conditions, FAQs and/or the Program or any aspect or feature of the Program at any time, although these changes may affect the value of rewards and/or Benefits already accumulated or earned and/or the ability to redeem accumulated rewards or Benefits. Any changes to these Terms and Conditions will be communicated by updating this page and the Program page at usa.erborian.com/erborian-seoulmate-loyalty-program.
We reserve the right to exclude you from the Program or to terminate your participation and verify your Account at any time at our sole discretion. Any suspected abuse of the Program, non-compliance with these Terms and Conditions, the general Terms and Conditions relating to the use of the Website, inactivity of your Account for more than 24 months, illegal activity, fraud, misrepresentation, or any other behavior not in accordance with these Terms and Conditions and/or detrimental to us or our interests, including, in particular, any illegal, fraudulent, and unauthorized use of Program rewards, points, cards, credits, vouchers, coupons, and/or certificates may result in termination of your membership and Account, thereby making you ineligible to participate in the Program. If your Account or membership is terminated, all rewards or Benefits in your Account will automatically expire, and you will lose access to the Program and its features. If we suspect illegal activity, fraud, misrepresentation, abuse, or violation of these Terms and Conditions or the Website Terms and Conditions, we also have the right to take appropriate legal action at our sole discretion.
If you decide to no longer be part of the Program, you can unsubscribe at any time. To close and delete your Account, you may contact Erborian customer service by email (UScustomerservice@erborian.com) or by phone at 1-866-464-3358 Monday through Friday 9AM to 5PM ET.
If you unsubscribe, you will lose all accumulated points, Benefits, unredeemed Rewards, and your status level. We also inform you that you can also exercise your rights regarding your personal data at any time. DISCLAIMER â LIMITATION OF LIABILITY
ERBORIAN, its parent companies, subsidiaries, affiliated companies, partners, or licensees may in no case be held liable in any way (contractual, non-contractual, as a guarantee, for intentional fault, gross negligence, or negligence) for (a) business interruption; (b) access delays, interruptions, changes to or termination of the Program; (c) non-delivery of data, loss, theft, delivery error, corruption, destruction, or any other modification; (d) losses or damages of any nature resulting from transactions or the presence of third-party links on the Website or the use of any Program Benefit; (e) computer viruses, system failures, or malfunctions that may occur when using the Website, including in a hyperlink to or from third-party websites; (f) any inaccuracy or omission in the Program content; or (g) events beyond our control.
We make no representation or warranty that defects or errors will be corrected. Furthermore, neither ERBORIAN nor its parent companies, subsidiaries, affiliated companies, partners, or licensees will be liable in any capacity whatsoever (contractual, non-contractual, warranty, intentional fault, negligence, gross negligence) for indirect, special, punitive, incidental, or consequential damages of any nature (including lost profits) related to the Program or your participation.
You acknowledge that you cannot take any action arising from or related to your participation in the Program, use of any Benefit, or these Terms and Conditions more than one (1) year after the event that generated the basis for the complaint or action. If you are not satisfied with the Program, canceling your Program membership is the only recourse. We have no other obligation, commitment, or responsibility to you.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless ERBORIAN and our parent companies, subsidiaries, affiliated companies, partners, licensees, managers, directors, employees, and agents from any liability arising from and/or related to any loss, damage, or cost, including legal fees resulting from claims, actions, or requests from third parties resulting from your participation in the Program in violation of any law, rule, regulation or these Terms and Conditions.
APPLICABLE LAW AND DISPUTES
This Program and these Terms and Conditions shall be governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to this Program or these Terms and Conditions shall be submitted to the exclusive jurisdiction of the state or federal courts located in New York, New York.
PERSONAL DATA
Personal data collected from you in connection with the Program, including for purchases made during your Program membership, will be processed by ERBORIAN in accordance with its Privacy Policy. To learn more about the processing of your data, click here.
SEVERABILITY
The provisions of this Program are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by ERBORIAN, or alternatively, by a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from these Terms and Conditions without affecting the validity, legality or enforceability of any of the remaining provisions.
NOTICE OF FINANCIAL INCENTIVE
Some state laws require that we disclose specific information about the Program's financial incentives. Through the Program, we may provide promotional offers, rewards or Benefits to Members as well as opportunities to participate in sweepstakes, loyalty or rewards programs or other promotional campaigns (collectively, "Promotions"), including the Program, which provide rewards, Benefits and special offers (such as accrual of rewards points for purchases) to Members. We will ask you to provide information about yourself in connection with the Program. This may include your name and contact information (such as email, mailing address, telephone number, birthday). You may obtain more details about how we use your information in our Privacy Policy. We also may collect and process your transaction information (such as purchases, rewards, and discount redemptions), information we generate, infer, or automatically collect about you and your purchases and interactions with us, and other information that allows us to tailor our communications, target ads, and provide offers, products, and services we think may be of interest to you.
Our business practice does not attribute a specific monetary value to personal information that you provide to participate in the Program; however, under California law, we are required to provide a good faith estimate of its value and the method used to calculate this value. The financial incentives we offer to consumers are reasonably related to the value of the consumer's data to our business. We calculate this in good faith based on our reasonable but sole determination using factors that include expenses we incur to collect, process and keep secure personal information. We also consider the expenses related to providing the financial incentive and administering the Program, which includes the costs of discounts, Rewards, and promotions applied or redeemed, as well as the costs and expenses associated with IT, marketing, administration, third-party services, and Program development costs.
Participation in any financial incentive program is optional, and you have the right to withdraw from participating in the Program at any time.
